End User License Agreement

1. LICENSE GRANT

Tobias Hohendanner ("Licensor") grants you a personal, non-exclusive, non-transferable, and revocable license to use Eggspence ("Licensed Application") on devices that you own or control, in accordance with the applicable App Store Terms and Conditions and this EULA.

Important: The Licensed Application is licensed, not sold. All rights not expressly granted herein are reserved by the Licensor.

This license permits you to:

• Install and use the Licensed Application on your personal devices
• Create an account and store your expense data
• Share expenses with other users of the application
• Access all features included in your chosen subscription tier

2. RESTRICTIONS AND EXPORT COMPLIANCE

You may not and agree not to:

• Reverse Engineer: Copy, modify, reverse-engineer, decompile, disassemble, or create derivative works of the Licensed Application
• Redistribute: Distribute, sell, rent, lease, sublicense, or otherwise transfer the Licensed Application to any third party
• Circumvent: Remove, disable, or circumvent any security measures, access controls, or usage restrictions in the Licensed Application
• Violate Laws: Use the Licensed Application in violation of any applicable laws, regulations, or third-party rights
• Export Violations: Use or export the Licensed Application in violation of applicable export laws or regulations
• Misuse Service: Upload illegal, harmful, or inappropriate content, or use the app to harass other users
• Commercial Use: Use the Licensed Application for commercial purposes without explicit written permission

3. SUBSCRIPTION SERVICES

3.1 Ad-Free Subscription

If you purchase our "Ad-Free" subscription service:

• Billing: The subscription is billed monthly and will automatically renew unless cancelled at least 24 hours before the end of the current billing period
• Payment: Payment will be charged to your Apple ID account (iOS) or Google Play account (Android) upon confirmation of purchase
• Management: You can manage, cancel, or modify your subscription in your respective App Store account settings at any time
• Pricing: Subscription prices may vary by country and currency. The exact price will be displayed before purchase
• Benefits: Ad-free experience and access to premium features as described in the app

3.2 Free Tier

The free version of Eggspence includes:

• Core expense tracking and sharing functionality
• Limited group and expense features
• Advertisement-supported experience

4. PRIVACY, DATA PROTECTION AND TECHNICAL DATA

Your privacy is important to us. Our collection, use, and protection of your personal data is governed by our comprehensive Privacy Policy, which can be found at:

4.1 Technical Data Collection

The Licensor may collect technical data, including device and usage information, to improve the application and provide support. This data is collected in a form that does not personally identify you and includes:

• Device performance metrics
• App usage statistics
• Crash reports and diagnostic information
• Feature usage patterns

By using Eggspence, you acknowledge that you have read and understood our Privacy Policy and consent to the data practices described therein.

5. INTELLECTUAL PROPERTY

The Licensed Application, including all content, features, functionality, and technology, is owned by the Licensor and is protected by international copyright, trademark, and other intellectual property laws.

All rights not expressly granted to you in this EULA are reserved by the Licensor.

6. THIRD-PARTY SERVICES

The Licensed Application may integrate with or provide access to third-party services, including but not limited to:

• Google Services: Firebase, Analytics, AdMob advertising
• Payment Processing: RevenueCat for subscription management
• Platform Services: Apple App Store, Google Play Store
• Authentication: Google Sign-In, Apple Sign-In

Your use of these third-party services is subject to their respective terms of service and privacy policies. The Licensor is not responsible for third-party services and you use them at your own risk.

7. TERMINATION

7.1 Termination by You

You may terminate this EULA at any time by:

• Uninstalling the Licensed Application from all your devices
• Deleting your user account through the app settings
• Discontinuing all use of the Licensed Application

7.2 Termination by Licensor

This EULA will terminate automatically if you fail to comply with any of its terms. The Licensor may also terminate or suspend your access to the Licensed Application at any time for:

• Violation of this EULA or applicable laws
• Misuse of the Licensed Application
• Non-payment of subscription fees
• At the Licensor's sole discretion

7.3 Effect of Termination

Upon termination of this EULA, you must immediately cease all use of the Licensed Application and delete it from all your devices. Your subscription will not be refunded upon termination for cause.

8. NO WARRANTY

The Licensed Application is provided "AS IS" and "AS AVAILABLE" without warranties of any kind, whether express, implied, or statutory, to the maximum extent permitted by applicable law.

The Licensor specifically disclaims all warranties, including but not limited to:

• Warranties of merchantability, fitness for a particular purpose, and non-infringement
• Warranties that the Licensed Application will be uninterrupted, error-free, or completely secure
• Warranties regarding the accuracy, reliability, or completeness of any content or data

9. LIMITATION OF LIABILITY

To the fullest extent permitted by applicable law, the Licensor's liability is limited as follows:

9.1 Excluded Damages

The Licensor shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including:

• Loss of profits, data, use, goodwill, or other intangible losses
• Damages from unauthorized access to or use of your data
• Damages from any conduct or content of third parties using the Licensed Application
• Damages from any interruption or cessation of the Licensed Application

9.2 Maximum Liability

In no event shall the Licensor's total liability exceed:

• The amount you paid for the Licensed Application in the twelve (12) months preceding the claim, or
• Fifty dollars ($50 USD), whichever is greater

10. INDEMNIFICATION

You agree to defend, indemnify, and hold harmless the Licensor from any claims, damages, obligations, losses, liabilities, costs, and expenses arising from:

• Your use of the Licensed Application
• Your violation of this EULA
• Your violation of any third-party rights
• Any content you submit through the Licensed Application

11. GOVERNING LAW AND DISPUTE RESOLUTION

11.1 Governing Law

This EULA is governed by and construed in accordance with:

• For EU/EEA residents: The laws of Austria and applicable EU regulations
• For all other users: The laws of Austria, without regard to conflict of law principles

11.2 Dispute Resolution

Any disputes arising under this EULA shall be resolved through:

• First: Good faith negotiations between the parties
• If negotiation fails: Binding arbitration or mediation in Austria
• For EU residents: You retain the right to bring disputes before the competent courts in your country of residence

12. UPDATES AND MODIFICATIONS

The Licensor reserves the right to modify this EULA at any time. Material changes will be communicated through:

• In-app notifications
• Email notifications (where applicable)
• Updates to our website

Continued use of the Licensed Application after modifications constitutes acceptance of the updated EULA.

13. SEVERABILITY

If any provision of this EULA is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary so that this EULA shall otherwise remain in full force and effect.
